2. The free movement of health care provision and patients

2.1. Professional rights of health care practitioners and doctors (Directive 2005/36 on the recognition of professional qualifications)
2.2. Public health as service: free movement of patients a. Regulation 1408/71, b. The ECJ case-law  

3. Financing national health systems in the EU context

3.1 The application of competition law and public sector contacts law on healthcare
a. How do competition law and public sector contacts law relate to one another? b. Criteria for choosing the applicable rule
3.2 Case studies: how is the above mentioned regulation applied in the healthcare systems of six EU member-states?

Objectives

The course aims to offer a comprehensive analysis of the multi-level system of healthcare protection to enable the students to understand how health law works. Special emphasis is placed on the comparative study of the regulation of the right to health in the international and European level.

Learning outcomes

Students should develop skills that will allow them to understand, compare, analyse and employ the international and EU legal rules that govern healthcare protection and the realization of the right to health. In addition students shall develop research skills and the ability to collect information and to write short or lengthier reports and essays.
